The construction method does not change the requirements, but it does change the process: because the factory works from fixed drawings, the permit design must be complete earlier. For buildings that are erected several times there is also the type approval (Typengenehmigung).<\/p>\n<h3 style=\"font-size: 22px; text-align: left; margin-top: 32px;\">Does a modular building need a building permit?<\/h3>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">Yes, as a rule. The building code of the respective federal state applies. It does not distinguish between a building made on site and one prefabricated in a factory. Buildings that are only set up for a few years, for example as an interim solution for a school, usually need a permit as well. Whether a small project qualifies for a permit exemption or a simplified procedure is decided by the local building authority.<\/p>\n<h3 style=\"font-size: 22px; text-align: left; margin-top: 32px;\">What is checked in the procedure<\/h3>\n<ul style=\"font-size: 18px; line-height: 1.6; text-align: left; margin: 0 0 18px 22px; padding-left: 0;\">\n<li style=\"margin-bottom: 8px;\"><strong>Planning law:<\/strong> does the project comply with the development plan or fit its surroundings in type and scale of use, height and buildable area?<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Building regulations:<\/strong> distances to boundaries, parking, accessibility and escape routes.<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Structural safety:<\/strong> the structural analysis for frame and foundations.<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Fire protection:<\/strong> depending on building class and use. Additional rules apply to special buildings such as schools, hospitals, hotels and high-rise buildings.<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Sound and thermal insulation:<\/strong> verification under DIN 4109 and the German Buildings Energy Act (GEG).<\/li>\n<\/ul>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">Components and connections must comply with the Technical Building Rules in force or have proof of usability, for example a national technical approval or general construction technique permit from the Deutsches Institut f\u00fcr Bautechnik (DIBt), or a European Technical Assessment.<\/p>\n<h3 style=\"font-size: 22px; text-align: left; margin-top: 32px;\">Type approval: check once, build many times<\/h3>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">Since 2019 the German model building code has included the type approval (section 72a MBO). It is granted for structures that are to be erected in the same design at several locations, and also for structures that vary in design but follow a defined system and use defined components. This matches serial and modular construction exactly.<\/p>\n<ul style=\"font-size: 18px; line-height: 1.6; text-align: left; margin: 0 0 18px 22px; padding-left: 0;\">\n<li style=\"margin-bottom: 8px;\"><strong>Validity:<\/strong> five years, extendable on application by up to five years at a time.<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Authority:<\/strong> the authority designated by state law, usually the highest building authority of the state.<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Effect:<\/strong> what has been checked in the type approval is not checked again by the building authority at the individual site.<\/li>\n<li style=\"margin-bottom: 8px;\"><strong>Limit:<\/strong> the type approval does not replace the procedure at the site. Planning law, boundary distances, foundations and utilities are checked for every plot.<\/li>\n<\/ul>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">The model building code is a template. The building code of each state is what counts, and not every state has adopted the type approval in the same form. Recognition of type approvals from other states also varies. Early coordination with the building authority of the state where you build is therefore worthwhile.<\/p>\n<h3 style=\"font-size: 22px; text-align: left; margin-top: 32px;\">Type testing: structural verification for recurring components<\/h3>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">Type testing (Typenpr\u00fcfung) is a different thing. It concerns structural safety only: the structural analysis for a component or frame that is always built the same way is checked once and can then be used in many projects.<\/p>\n<h3 style=\"font-size: 22px; text-align: left; margin-top: 32px;\">New flexibility for housing: the 2025 acceleration law<\/h3>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">The Act to Accelerate Housing Construction, known in Germany as the \u201cBau-Turbo\u201d, has been in force since 30 October 2025. The new section 246e of the Federal Building Code allows deviations from planning law for housing until the end of 2030 if the municipality consents. This covers new buildings, extensions and added storeys that create new homes, and the conversion of existing buildings into housing. If the municipality does not respond within three months, consent is deemed to be given. The requirements of the state building code, for example on fire protection and structural safety, remain in place.<\/p>\n<p style=\"font-size: 18px; line-height: 1.6; text-align: left;\">This matters most for <a href=\"\/en\/modular-building-guide\/adding-storeys-modular\/\">added storeys<\/a> and for <a href=\"\/en\/modular-building-guide\/office-to-residential-conversion\/\">converting offices into homes<\/a>, because neither needs new building land.<\/p>\n<h3 style=\"font-size: 22px; text-align: left; margin-top: 32px;\">How the design phase saves time<\/h3>\n<ol style=\"font-size: 18px; line-height: 1.6; text-align: left; margin: 0 0 18px 22px; padding-left: 0;\">\n<li style=\"margin-bottom: 8px;\">Involve the modular construction partner before the design is fixed, so that grid and building system fit the design.<\/li>\n<li style=\"margin-bottom: 8px;\">Talk to the building authority early, and for special buildings also to the fire authority.<\/li>\n<li style=\"margin-bottom: 8px;\">Submit a complete permit design. Changes after production starts are expensive.<\/li>\n<li style=\"margin-bottom: 8px;\">Use the waiting time: while the procedure runs, the production design is prepared.
